Terms of Service

These Terms of Service ("Terms") govern your access to and use of MissionKonsol (the "Service"), operated by Toby Aguero ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
What MissionKonsol is
MissionKonsol is a workstation for running startup operations: a guided diagnostic that scores your business across several operational dimensions, an AI-backed advisor chat, a visual canvas for mapping processes and org structure, and a generator for real business documents (SOPs, decision-rights matrices, onboarding checklists, escalation and communication policies). Publishing, integrations, and automation are limited to what's actually built and documented in the product at any given time — the Service may add, change, or remove features without notice.
AI-generated content — read this before you rely on anything MissionKonsol writes
The Systems Diagnostic's recommendations, Secretary's replies, and every document Playbook generates (including SOPs, RACI matrices, onboarding checklists, and escalation and communication policies) are produced by an AI model (currently Google Gemini). AI-generated content can be inaccurate, incomplete, outdated, or simply wrong for your specific situation. None of it is legal, HR, compliance, financial, or professional advice. Before you adopt a generated document as an actual policy, before you rely on Secretary's recommendation for a real decision, or before you treat a diagnostic score as a definitive assessment of your business, review it yourself or have a qualified professional review it. You are solely responsible for how you use anything MissionKonsol generates.
Accounts and workspaces
Creating an account gives you a workspace (organization) that you own. Diagnostics, canvases, and generated documents belong to the workspace and are visible to everyone you invite into it — Secretary conversations are the one exception and stay private to whoever started them. You're responsible for what happens under your account, including actions taken by anyone you invite. Don't share your login credentials.
If you own a workspace with other people in it, you can't currently delete your own account without first removing them or transferring ownership manually (contact us) — there is no automated ownership-transfer flow yet.
Plans and billing
MissionKonsol offers a Free plan (limited diagnostics and documents, no Canvas or Secretary access) and a paid Pro plan, billed monthly per workspace regardless of how many people are in it. Payments are processed by Stripe — we never see or store your full card details. Subscriptions renew automatically until canceled; you can cancel or manage billing at any time through the billing portal linked from your account page. Cancellation takes effect at the end of the current billing period; we don't offer refunds for partial periods except where required by law.
Automatic renewal disclosure (Texas Business & Commerce Code Chapter 605). The Pro plan is a subscription that renews automatically each billing period at the then-current price until you cancel — this page and the checkout screen both disclose that before you subscribe. Canceling doesn't require a phone call or a mailed letter: it's a one-click action in the self-service billing portal linked from your account page, available any time, with no more friction than signing up.
Acceptable use
- Don't use the Service for anything illegal, or to generate content that's illegal, harassing, or fraudulent.
- Don't attempt to circumvent usage limits (including the anonymous free-generation limits on the public generator) through automation, multiple accounts, or other workarounds.
- Don't scrape, reverse-engineer, or attempt to extract the underlying prompts or models behind the Service.
- Don't use the Service to build a directly competing product.
Termination
You can delete your own account at any time from your account settings (subject to the workspace-ownership limitation above). We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a security risk.
Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, error-free, or that AI-generated output will be accurate or fit for any particular purpose. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including decisions made or documents adopted based on AI-generated content.
Changes to these Terms
We may update these Terms as the Service changes. Continued use after an update means you accept the revised Terms.

Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction and venue there.
